1) Agreement

These Terms of Service (“Terms”) govern your access to and use of OfferPay’s website and the OfferPay Creator Program (the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

2) Eligibility

You must be legally able to enter into a contract in your jurisdiction.
You must provide accurate and up-to-date information.
You must not be banned or restricted from using our Services.

3) Account & Google Sign-In

You may create an account via Google Sign-In.
You are responsible for any activity that occurs under your account.
You must notify us immediately if you suspect unauthorized access.

4) Creator Program & Commissions

The Creator Program allows you to share a referral link and earn commissions when users attributed to your link perform qualifying actions.

Commission rate: The default commission rate is 15% on qualifying withdrawals, unless updated by OfferPay.
Qualification: Commission is earned only for valid, successful withdrawals attributed to your referral link and not flagged as fraud/abuse.
Adjustments: We may reverse commissions for chargebacks, fraud, policy violations, duplicate/self-referrals, or erroneous tracking.
Program changes: OfferPay may change commission rates, payout schedules, or eligibility rules with notice where reasonable.

5) Payouts

Payout availability depends on meeting required thresholds and compliance checks.

Minimum payout: ₹1,000 INR (unless changed by OfferPay).
Payout cycle: Weekly (unless changed by OfferPay).
Payment methods: May include UPI, bank transfer, and PayPal (availability may vary by region and compliance requirements).
Verification: We may require identity and payout verification to prevent fraud and comply with legal obligations.

6) Prohibited Conduct (Strict)

You agree you will NOT:

Make misleading claims (e.g., “guaranteed earnings” or “guaranteed winnings”).
Use spam, bots, fake accounts, incentivized clicks, or any artificial traffic.
Self-refer, create multiple accounts to exploit payouts, or manipulate attribution.
Promote in violation of platform rules (YouTube/Instagram/Discord/etc.).
Attempt to hack, reverse engineer, or interfere with the Services.
Use the Services for illegal activity, fraud, or money laundering.

Violation may result in suspension, commission forfeiture, payout cancellation, and permanent ban.

7) Content & Branding

You may not use OfferPay’s name/logo in a way that suggests official endorsement unless we approve.
You may not run ads impersonating OfferPay or using misleading domain names/creatives.
You are responsible for your promotional content and compliance with applicable laws and platform policies.

8) Suspension & Termination

We may suspend or terminate access to the Services at any time for security, legal compliance, or policy violations. You may stop using the Services at any time.

9) Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted operation, error-free tracking, or specific earnings outcomes.

10) Limitation of Liability

To the maximum extent permitted by law, OfferPay will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Services.

11) Indemnity

You agree to indemnify and hold OfferPay harmless from any claims, damages, liabilities, and expenses arising from your use of the Services, your promotional content, or your violation of these Terms.

12) Changes to Terms

We may update these Terms from time to time. The “Effective date” will reflect the latest version. Continued use means you accept the updated Terms.
